We have bent the fillet plates flat upon themselves and the piece did not break completely apart.  The fillet welds however did fracture.  My interpretation of 4.30.4.1 is the welder test are good?

Sounds like to me you had the plate / weld in the wrong direction when trying to break, I have never had a fillet weld not break open.

    Was the weld facing up or down ?

I walked into the lab one day, and saw a fillet weld test bent away from the face, I asked the tech what the hell he was doing, he said, "if I bend it the other way, it'll break":)

However
having said that, i think that 4.30.4.1 is quite clear, if it passes visual before break, and doesn't break, it passes.  Provided, of course, it's bent away from the root.
