Code: D1.3 & D17.2
The weld call out in question is a fillet weld that is .400"  The print references D1.3 as well as D17.2 (which is on order).

The engineer has asked me a question that I can't seem to find the answer to so I'm

1.) What is the maximum and minimum allowable leg sizes?  I deal with JD code on a daily basis and it states that the leg length can be 1mm under and 3mm, with no more than 3mm between the two
     legs.
2.) Is there a tolerence on the length of a weld as well per the above mentioned codes?

Slightly confused with the question.

Are we talking about a .400 weld size (leg length)  ?
or a .400 weld length (how long the weld is) ?

Also D17.2 is a Specification for Resistance Welding and I'm having a hard time seeing how it would apply to your question.

For D1.32.3.3 Fillet Welds
2.3.3.1 Minimum Length. Minimum length shall be 3/4 in [19 mm].

2.3.3.2 Leg Sizes. Leg sizes of lap joint fillet welds
shall be equal to the thickness of the thinner sheet steel
(see Figure 2.7).
The leg size of the T-joint fillet welds shall be equal to the thickness of the thinnest sheet steel (t) (see Figure 2.8).

I don't think D1.3 speaks to Maximum size of fillets or overwelding.

If you were speaking to D17.1 rather than D17.2 
This specification does have a number of requirments that differ from D1.3 in both minimum and maximum fillet sizes (leg length)... See 4.3.3 and Table 7.1

.400 is the weld length.  Sorry...

On this particular weldment there is some Resistance welding as well.
